TEXAS COMMONLAW MARRIAGE


So you've been living together for years in Texas. You must be married, right?

 

Maybe not.

 

Under Texas law, you can enter into a commonlaw marriage one of two ways.

1 - You can go down to a county courthouse and declare a commonlaw marriage.

 

2 - You can meet three conditions, without declaring it. If you

a - actually reside together, instead of just sleeping together; and you

b - consider yourselves married; and you

c - hold yourselves out to the community as being married, then you're married.
